Joseph S. McMillen

Joseph S. McMillen received his Juris Doctor in 1994 from University of San Diego School of Law, where he was a Trial Advocacy Mock Trial Finalist, an intern in the appellate divisions of the San Diego County District Attorney’s office and the for the Orange County Public Defender as well as being a member of the Christian Legal Society and the intercollegiate surf team. In 1991, Mr. McMillen graduated summa cum laude (Top 1%) from the University of California, Los Angeles with a degree in economics and business.

Prior to associating with Hines Carder , Mr. McMillen represented corporate policyholders in state and federal courts throughout the world in insurance coverage and extra-contractual disputes involving underlying intellectual property, antitrust, business tort, and employment claims. He also litigated trademark, trade dress, trade secret, copyright, false advertising, unfair competition, construction and general business matters. Mr. McMillen has represented numerous Fortune 500 companies in a broad range of industries. He was on a team of lawyers which recovered a $51.6 million judgment for a Fortune 100 company in relation to an underlying antitrust, patent and trademark dispute.

Mr. McMillen was the lead attorney in the published case of Ohio Cas. Ins. Co. v. Biotech Pharmacy, Inc., 547 F. Supp. 2d 1158 (D. Nev. 2008), where he obtained $750,000 in policy benefits for his client after drafting a successful summary judgment motion which clarified an insurer is not entitled to reimbursement of defense costs under Texas law. Mr. McMillen was the lead attorney in the case of JACO Environmental, Inc. v. AISLIC, 2009 WL 1591340 (W.D. Wash. May 19, 2009), where he drafted a successful summary judgment motion finding his client’s insurer breached the duty to defend an underlying false advertising and patent case. Presently, Mr. McMillen specializes in the areas of insurance coverage analysis and litigation and general business litigation.

Mr. McMillen is licensed to practice before all courts of the State of California. When not practicing law, Mr. McMillen enjoys playing basketball, surfing, and spending time with his family.
